Copyright Protection in Thailand

In the Kingdom of Thailand, copyright protection for creative work is the life of the author/creator plus 50 years. However, if the author/creator is a legal entity or anonymous, copyright protection is only for 50 years from the date of publication. For international copyright protection in Thailand, if the author/creator is a national or resident of a country that is a signatory to the Berne Convention for the Protection of Literary and Artistic Works or the WTO’s Trade Related Aspects of International Property Rights (TRIPs) or the creative work was first published in one of the signatory countries, no additional formalities are required to protect or enforce international copyright in the Kingdom as Thailand is also a signatory to the Berne Convention and TRIPs. While copyright for creative work, regardless of where it was produced, immediately becomes the property of the author/creator, copyright recordation with the Copyright Office in Thailand’s Department of Intellectual Property in the Ministry of Commerce is still recommended. Anurak and Associates handles all copyright matters for Thailand including recordation process for copyrights at the Copyright Office which takes four to five months after the application has been filed. For copyright infringement, civil and criminal prosecution is possible, and the IP team works together with the Litigation Department on these matters.

Q. Is Thailand a member of the Madrid Convention?

A. Yes, Thailand ratified and joined the Madrid Convention.

Q. Is legal enforcement in Thailand against IP infringers workable?

A. Mostly yes, but it does depend on the nature of the case and the supporting evidence.

Q. Do you offer “Cat ‘n’ Mouse” work against IP infringers?

A. Yes, but only for big cats.
